E [D NOTICE OF RE TREMENT FOR CASE MANAGEMENT PLAI
THIS CASE (identified by the email Notice of Service of Court Documents) came
before the Court upon review of the Court’s docket pursuant to the Fourth Judicial Circuit Court
Administrative Order No. 2021-21 (AO No. 2021-21). The Court finding this case is appropriate for
entry of a Case Management Plan and Order and that the parties have failed to file a Case
Management Plan as required by the Court’s prior Notice, it is ORDERED:
1. This Notice does not constitute record activity in this case for purposes of Florida Rule of Civil
Procedure 1.420(e).
2. A Case Management Plan is not required for cases in which (a) a Uniform Order Setting Case
for Jury Trial, an Order for Pre-Trial Conference and Requiring Pre-Trial Matters to be
Completed, or other order setting the case for trial has been filed and served and is in force and
effect; (b) an order establishing case management deadlines has previously been filed and served
and is in full force and effect; or (c) a Petition for Transfer of Settlement Rights has been filed.
For any reason set forth above, or for any other reason counsel may determine, a Case
Management Plan should not be required, then Plaintiff, if represented, or Defendant, if Plaintiff
is not represented by counsel, shall file a notice and serve that notice to all parties and the
presiding Judge setting forth the reason(s) why a Case Management Plan is not required.

3. Counsel and unrepresented parties for cases filed before April 30, 2021, shall immediately
review AO No. 2021-21 and meet and confer to identify whether this case shall proceed as
complex, streamlined, or general. The parties must agree upon the terms and conditions of an
appropriate Case Management Plan.
If the case is complex, the parties must proceed pursuant to Florida Rule of Civil Procedure
1.201 and not file a Case Management Plan as described in this Notice. If the case is streamlined
or general, the parties must file a Case Management Plan, that corresponds to the type of case.
These Case Management Plans are attached to AO No. 2021-21 as Exhibits A and B (electronic
copies may be found on the Fourth Judicial Circuit website.)
Upon completion of the Case Management Plan, Plaintiff or Plaintiff's counsel shall file the
Case Management Plan in the Court file. The Case Management Plan shall be filed within ten
(10) days from receipt of this Notice.
If the parties are unable to agree on the terms of an appropriate Case Management Plan, the
Parties shall notify the presiding Judge and file their respective proposed Plans.
Counsel shall promptly serve and file proof with the Clerk, no more than five (5) business days
from the date of filing the Case Management Plan, that all unrepresented parties, subsequently
named or appearing in this case, have been served copies of the Plan.
Failure to file a Case Management Plan as required by this Notice and Order will subject
the parties to enforcement action by the Court.
Ifa party is pro se and has not designated an email address for purposes of electronic service,
counsel for Plaintiff shall be responsible for serving this Notice, the Case Management Plan, and
all orders of the Court via non-electronic means (U.S. mail, Federal Express or the equivalent).
In relation to the Case Management Plan and all orders of the Court, counsel for Plaintiff shall
file a Certificate of Service with the Court indicating who was served, the date of service, and the
method of service (including any address or email address used) within three (3) business days.
If Plaintiff is not represented by counsel, Counsel for Defendant shall have this same obligation.
If all parties are unrepresented, Plaintiff shall provide stamped addressed envelopes to the Court
with submission of the Case Management Plan and any other proposed Order.
