On the 21* day of February, 2023, Petitioner, Ivan Guillen’s Motion for Entry of
Temporary Orders came on for consideration by the Court, whereupon the Court having been
informed on the record by each Party that he had reached an agreement, the Court finds good
cause for granting certain relief. It is accordingly...
ORDERED:
Petitioner’s request for entry of Temporary Orders is hereby GRANTED. The Parties
Agreement for entry of the following Temporary Orders is approved.
Beginning on March 1, 2023 and continuing thereafter until the home located at 5515
Forest Cove Drive, Dickinson, Texas 77539 is either sold, or the Respondent, Kellen Durham is
able to obtain refinancing of the existing mortgage in his name only, Kellen Durham shall be
solely responsible for the timely, prompt, payment of any and all expenses, and indebtedness
related to the home, including but not limited to payment of each and every mortgage payment
when each becomes due.
IT IS FURTHER ORDERED:
Beginning immediately, Kellen Durham shall make due diligent efforts which are
necessary to either obtain refinancing of the home in his sole name, or to sell the home at its
current fair market price. In this regard, he shall keep the home neat, and clean, shall not do
anything calculated to cause the home not to sell, and shall not interfere with the efforts of real
estate agents to sell the home, or their showing of the home to prospective buyers.
These Temporary Orders shall remain in full force and effect pending further order of the
Court. They shall not affect the division of sale proceeds if and when the home sells, nor
Petitioner, Ivan Guillen’s claim for reimbursement of expenditures related to the home.
