Plaintiff is duly authorized to sell insurance in the State of Ohio, and at all times hereinafter mentioned, had in full force and effect a policy of insurance which provided Collision and Rental coverage to MARYANN IFFLAND (hereinafter referred to as "Insured") Said policy was subject to a $100.00 deductible. 2. On or about 10/01/21, in Monclova Township, Lucas County, Ohio, Defendant KARL OPALINSKI negligently operated:a motor vehicle whereby he caused a Multi Vehicle collision to occur between the motor vehicle he was operating and a motor vehicle owned by Insured. 3 As a direct and proximate result of said negligence, Insured incurred damage to Insured's motor vehicle in the amount of $20,091.17. a 4 As a further direct and proximate result of said negligence, the insured sustained personal injuries and medical bills. 5 Pursuant to the above-mentioned policy of insurance, the Plaintiff was required to and did pay to and or on behalf of its Insured the sums of $19,991.17 and $5,000.00 under the Collision and Medical Payments coverage provisions, respectively, and is thereby subrogated in those amounts, less a net salvage recovery of $2,075.00. COUNT TWO 5. Plaintiff hereby incorporates paragraphs one through four of this Complaint as if fully restated herein. 6. At the time of the aforementioned collision, Defendant KARL OPALINSKI was operating the subject motor vehicle within the course and scope of his. employment, and/or as an agent of Defendant MN EXPRESS INC thus making Defendant MN EXPRESS INC vicariously liable for his actions. WHEREFORE, Plaintiff STATE FARM MUTUAL AUTOMOBILE INSURANCE COMPANY demands judgment against Defendants, jointly and severally, in the amount of $22,916.17, plus costs and interest.
