PLAINTIFFS’ VIOLATION OF LIMIN E ORDER
Subject to their motion for mistrial, and subject to their objections stated on the record that
no instruction is capable of curing the Plaintiffs’ Violation of the Court’s Limine Order and that any
attempted instruction will only serve to highlight the testimony presented by Plaintiff Wendy
Diamond in Violation of the Court’s Limine Order, Defendants IPwe, Inc. and Erich Spangenberg
(“Defendants”) tender to the Court the following proposed instruction to be read to the jury in this
case:
In her testimony yesterday, Plaintiff Wendy Diamond violated
express rulings of this Court. Whether intentional or unintentional,
Ms. Diamond’s testimony was a serious Violation of this Court’s
Order that put this trial in jeopardy. She has been admonished by
the Court. You are to disregard any testimony from Ms. Diamond
regarding prior lawsuits or the net worth of any party. There is no
evidence that the testimony regarding either of these issues is true
or accurate, and you must not consider it as evidence in your
consideration of any issue in this case.
