TO THE HONORABLE JUDGE OF SAID COURT:

       COMES NOW, Defendant, Texas Ally Real Estate Group, LLC (hereinafter referred

to as “Defendant”), and gives written notice to this Court, and to all parties to this suit, that

it is taking a nonsuit, without prejudice, as to its Counterclaim against Plaintiffs Stacey

Diamond and Jeffrey Diamond, and would respectfully show the Court that at this time it

does not desire to prosecute its Counterclaim against Plaintiffs Stacey Diamond and Jeffrey

Diamond.

       THEREFORE, Defendant, Texas Ally Real Estate Group, LLC asks the Court to take

notice that it has nonsuited, without prejudice, its Counterclaim against Plaintiffs Stacey

Diamond and Jeffrey Diamond, in the above-styled lawsuit.
