ORDER ON
DEFENDANTS' MOTION TO ABATE
On , the Court heard the Defendants’ Motion to Abate and the Plaintiffs'
response thereto. After due consideration of the Motion, the response, and the arguments of
counsel, this Court is of the opinion that such Motion should be SUSTAINED.
The Court finds the following:
Defendant David H Hamilton, Trustee for TH Trust, is the plaintiffin this case. On March
4, 2020, this Court signed an Order on Disqualification by the terms of which the Court disqualified
George M. Bishop from serving as attorney of record for said plaintiff. Although the order signed
by the Court required that Mr. Bishop promptly provide the Court and opposing counsel with
appropriate contact information for said plaintiff, including his address, telephone number and
email address or contact information for successor counsel, Mr. Bishop has failed to do so. Asa
result, these defendants are unable to give service of notices and pleadings to said party of its
responses to outstanding discovery, its responses to two motions for summary judgment heretofore
filed by Mr. Bishop, or to otherwise comply with applicable rules.

Defendant David H Hamilton, Individually is a Counter-Defendant and K. M. Bishop is a
Cross-Defendant this case. On March 4, 2020, this Court signed and Order on Disqualification by
the terms of which the Court disqualified George M. Bishop from serving as attorney of record for
said parties. Although the order signed by the Court required that Mr. Bishop promptly provide
the Court and opposing counsel with appropriate contact information for said parties, including
their addresses, telephone number, and email addresses or contact information for successor
counsel, Mr. Bishop has failed to do so. As a result, these Defendants are unable to give service
of notices and pleadings to said party of its responses to outstanding discovery, its responses to
two motions for summary judgment heretofore filed by Mr. Bishop, or to otherwise comply with
applicable rules.
IT IS, THEREFORE, ORDERED that this cause is suspended until Plaintiffs cure the
defects set forth herein, but no later than May 1, 2020.
