Plaintiff is advised that the notice of motion must include notice of
the court’s tentative ruling procedures. (Local Rule 20.2.3(c).)
Plaintiff’s Motion to Compel Requests for Production of Documents, Set
Two
All moving papers and supporting papers shall be served and filed at
least 16 court days before the hearing. (Code Civ. Proc., § 1005, subd.
(b).) The notice period is increased by five calendar days when service
is by mail. (Ibid.) Plaintiff's motion was served with insufficient
notice. However, as defendant is willing to waive the procedural
defects, the motion to compel is granted. Defendant Placer Valley
Sports Complex is ordered to serve verified responses and responsive
documents to requests for production, set two, no later than October
11, 2022.
Plaintiff’s request for sanctions is denied. The notice of motion fails
to identify the person, party, or attorney against whom sanctions are
sought, and fails to state the statutory basis for the
request. Additionally, plaintiff is not entitled to discovery sanctions
as a self-represented litigant. (Code Civ. Proc., § 2023.040; Argaman
v. Ratan (2d Dist. 1999) 73 Cal.App.4th 1173, 1179; Kravitz v. Superior
Court (2d Dist. 2001) 91 Cal.App.4th 1015, 1021.)
