Plaintiff’s Motion to Compel Requests for Production of Documents, Set Two All moving papers and supporting papers shall be served and filed at least 16 court days before the hearing. (Code Civ. Proc., § 1005, subd. (b).) The notice period is increased by five calendar days when service is by mail. (Ibid.) Plaintiff's motion was served with insufficient notice. However, as defendant is willing to waive the procedural defects, the motion to compel is granted.
