The Court heard oral arguments on Defendant's Brief as to Why No Derivative Claims should be
Permitted for Alleged Violations of Labor Code Section 226.
After oral arguments, the Court denied the Defendant's request to deny certification of the class claim for
an alleged violation of Labor Code Section 226.
Regarding the Order to Grant Class Certification, the Court directed defense counsel to prepare a
revised order and submit to Plaintiff for approval as to form as more fully stated in the record.
The Court sets a case management conference for December 18, 2019 at 2:00 p.m. to address the
status of the meet and confer efforts regarding the trial presentation and management plan.
The plan should encompass questions 1-9 of the supplemental case management questionnaire for
PAGA cases, the parties are to meet and confer and address the issues regarding questions 1-8 of the
minute order found at Register of Actions #440, address whether there should be imposition of timelines,
and address other topics regarding the mechanics of the trial that the parties request the court to
consider.
Plaintiff (s) is ordered to file a trial plan by January 24, 2020.
Defendant response is ordered to file by March 6, 2020.
Plaintiff(s) is ordered to file response by March 20, 2020.
The Court sets a Case Management Conference for April 3, 2020 at 1:30 p.m. to discuss elements of
