1 I, Timothy J. Long, hereby declare as follows:
2 1. I am an attomey duly admitted to practice before the courts of the State of
3 Califomia and a shareholder in the law firm of Greenberg Traurig, LLP, attomeys of record for
4 Defendant Health Net of Califomia, Inc. ("HNCA"). I make this declaration on personal
5 knowledge and, if swom as a witness, could competently testify to the following facts except
6 where otherwise indicated.
7 2. On December 5, 2018,1 deposed Plaintiff Andrea Spears. A tme and correct copy
8 of the relevant portions of Ms. Spears' deposition transcript is attached hereto as Exhibit A.
9 3. On April 4, 2017, Ms. Spears provided notice to the Califomia Labor and
10 Workforce Development Agency of alleged violations ofthe Califomia Labor Code. A tme and
11 correct copy of the relevant portion of that notice is attached hereto as Exhibit B.
12 4. On March 12, 2020, the parties in Heredia v. Eddie Bauer LLC, No. 5:16-cv-

United States, including retail stores that are located in various places throughout Califomia.

2. From September 2012 through the present, Eddie Bauer has operated 13 stores in

6 3. Plaintiff worked for Eddie Bauer as a sales associatefromon or about November 15,

2013, to on or about March 26, 2016.

4. Eddie Bauer has a written policy entitled "Package/Personal Property Checks," regarding
9
exit inspections or bag checks. The written policy entitled "Package/Personal Property Checks" is silent
10
as to whether exit inspections or bag checks are required to be conducted on the clock or off the clock.

,5. Eddie Bauer's written policy entitled "Package/Personal Property Checks," states, in
12
relevant part, that: "[a]ll associates must have their handbags, packages, briefcases, backpacks and other
13
parcels^ inspected by a member of store management whenever they leave the store."
14
6. Eddie Bauer's written policy entitled "Package/Personal Property Checks" specifies that
15
it is the employee's "responsibility to seek store management and have his/her package or personal
16
items checked."

7. As for the inspection itself, uponfindingan available manager, an employee is to open
18
his/her bag for the manager to see inside, and may be asked to move items around in the bag to allow the
19
manager to better see what is in the bag.

8. The "Package/Personal Property Checks" policy is designed to reduce/prevent
21
shrinkage/intemal theft.

9. The PAGA period commences on July 5, 2015.

10. During Plaintiffs employment with Eddie Bauer, she worked 64 total shifts.

11. During Plaintiffs employment with Defendant, her last hourly rate of pay was $10.00.

1. Eddie Bauer requires all of its retail employees to submit to a security inspection before

exiting the store at the end of a shift, regardless of whether they have a bag or not.
