TENTATIVE RULING
On motion of the court, this matter is continued to 6/1/2018 at 09:00AM in this department. If the new
date is inconvenient, then counsel shall meet and confer and, no later than 4:00PM today, inform the
Department 54 Clerk of their request for a subsequent date that does not fall between 6/08/18 and
6/13/18.
Counsel are directed to resume the meet-and-confer process and discuss Plaintiff Spears' proposal to
enlist the assistance of third-party Setec Security Technologies, Inc. to extract data--without personal
identifying information--from the payroll and time-keeping systems Health Net has used during the
proposed class period. To the extent feasible, counsel shall allow appropriate experts to participate in
the discussions. The court expects counsel to weigh the costs associated with Spears' proposal versus
the costs of sampling, which Health Net currently favors.
Nothing in this order compels a party to disclose an expert opinion or report.
