                                 PLAINTIFFS' CASE MANAGEMENT STATEMENT
 1                               CASE MANAGEMENT STATEMENT
2          On Febmary 26, 2021, the Court scheduled a case management conference for July 9, 2021
 3 at 9:00 a.m. in Department 41, to take place after the mediation scheduled for June 8,2021. The Court
4 fiirther directed the parties to submit case management statements at least 15 days prior to that case
 5 management conference. Accordingly, Plaintiffs Andrea Spears and Tomas Arana ("Plaintiffs") and
 6 Defendant Health Net of Califomia, Inc. ("Defendant") (collectively with Plaintiffs, "the Parties")
 7 now submit this case management statement to the Court.
 8                                    OUTCOME OF MEDIATION
 9         The Parties agreed to pursue private mediation with mediator Tripper Ortman on June 8,2021.
10 Although the case did not settle at mediation on June 8, 2021, through continued negotiations with
11 the mediator, the Parties were able to reach a tentative settlement, reflected in a Memorandum of
12 Understanding ("MOU") executed on June 21, 2021. The Parties are drafting a longform settlement
13 agreement, after the execution of which. Plaintiff will file a Motion for Preliminary Approval of Class
14 Action Settlement ("MPA").
15         The 5-year deadline to complete trial in this case is currently April 5, 2022, which is tolled,

16 pursuant to the terms ofthe MOU.
17                                       CASE MANAGEMENT

18          The Parties respectfiilly request that a further CMC be set for ninety (90) daysfi'omthe CMC,

19 or a date thereafter convenient for the Court, to permit the Parties sufficient time to negotiate the
20 longform settlement agreement and file the MPA.
