26 1. I am an attomey at law duly licensed to practice in all courts of the State of
27 Califomia. I am a principal in the law firm of Jackson Lewis P.C, attomeys of record for
28 Defendant Liqui-Box Corporation in the above-captioned action. I have personal knowledge of

8 between me and opposing counsel wherein opposing counsel repeatedly refused to provide
9 defense counsel with an agreed upon form of an electronic version of Plaintiffs Separate
10 Statement of Undisputed Facts and refused to provide defense counsel with the electronic version
11 of Separate Statement of Undisputed Facts that was used to create the Separate Statement of
12 Undisputed Facts Plaintiff filed with the Court. I repeatedly informed Plaintiffs counsel that they
13 were in violation of Califomia Rule of Court 3.1350, but they refused to provide an electronic
14 version as required by the Rule.
15 5. Attached hereto as Exhibit D are true and correct copies of excerpts from
16 the deposition of Sajida Zaman taken in this case on June 28, 2022. Plaintiff Sajida Zaman has
17 claimed that she does not fluently speak or understand English. In her deposition, on multiple
18 occasions, Plaintiff testified, " I do not know English" (38:4; 39:6-16; 136:15); she further
19 testified, "all papers written in English look the same to me" (42:6); and "the interpreter is here
20 because I need help in interpreting into Urdu and English" (72:12); 80:15-84-22 and Ex. 3
21 thereto; 105:20-110:18.

meta data and work product as mentioned.
Why don't you just convert the PDF document using OCR text recognition? This is your burden, not mine and as far as I

3.1350 says the format o f t h e electronic document has to be agreed upon. The purpose o f t h e rule is to allow us to
easily work with the document without having to do conversions and formatting that can be easily eliminated by deliver
of an electronic version that can be worked with. Delivering us a pdf is no more useful than giving us a paper document
that we turn into a pdf ourselves.
You can scrub the Word version. Please do so and provide it by noon tomorrow. Our position is that your pdf is not
compliant with the CRC. Why can't you scrub it and send it in Word?
