21 located at 8601 Rolling Green Way in Fair Oaks, Califomia. FLORENTINE ABBOTT acted as
22 the owner-builder in the construction of both the home and the adjacent cul-de-sac. RONALD
23 PAUL BRITSCHGI, individually and dba BRITSCHGI CONSTRUCTION is a licensed general
24 contractor who was hired by the ABBOTTS to provide assistance with the constmction ofthe
25 ABBOTT home through thefi-amingstage. RICHARD KIRK RUYBALID, individually and dba
26 CA CONSTRUCTION is a licensed general contractor who was hired by the ABBOTTS to
27 supply and install the concrete foundation system for the home. Defendant MARK SMITH dba
28 GROUNDBREAKERS is a general contractor who performed grading work on the lot where the

PROPOSED JOINT STATEMENT OF THE CASE
1 ABBOTT home was to be built. CADRE DESIGN GROUP, INC. ("CADRE") is a designer that
2 drafted the plans for PLAINTIFFS' home.
3 The ABBOTTS have sued BRITSCHGI, CA CONSTRUCTION and
4 GROUNDBREAKERS for claims of defects arising out ofthe construction of their home. The
5 defendants deny such claims.
6 CADRE and BRITSCHGI have resolved all claims against them. The only remaining
7 parties to this case are plaintiffs the ABBOTTS and Defendants CA CONSTRUCTION and
8 MARK SMITH
