SUPERIOR COURT OF CALIFORNIA, COUNTY OF SACRAMENTO GORDON D SCHABER COURTHOUSE MINUTE ORDER Date: 08/13/2009 Time: 09:00:00 AM Dept: 54 Judicial Officer Presiding: Judge Shelleyanne W L Chang Clerk: E. Higginbotham Bailiff/Court Attendant: None ERM: None Case Init. Date: 11/10/2007 Case No: 07AS04450 Case Title: RODNEY ABBOTT. ET AL VS. RONALD PAUL BRITSCHGI. ET AL Case Category: Civil - Unlimited Event Type: Motion - Other - Civil Law and Motion Causal Document & Date Filed: Appearances: Nature of Proceeding: Motion for Leave to Reopen Discovery TENTATIVE RULING This matter is continued on the Court's own motion to August 27, 2009. The Court agrees with defendant Britschgi's opposition on the ground that the moving papers were vague as to the specific relief requested. Plaintiffs clarified their request in their reply papers, but defendants have not had an adequate opportunity to address the request as so clarified. This would be sufficient grounds to deny the motion. However, in anticipation that plaintiffs may renew their motion setting forth more particulars, and in the interest of judicial economy, the Court concludes a continuance of this matter would be the most efficient means to resolve this dispute. Defendants may file and serve supplemental briefs responding to the scope of discovery plaintiffs propose in their reply papers no later than August 24, 2009. COURT RULING There being no request for oral argument, the Court affirmed the tentative ruling. Date: 08/13/2009 MINUTE ORDER Page: 1 Dept: 54 Calendar No.:
