We received the Court's May 3, 2011 notice pertaining to my client CA Constmction's
request for an ex-parte hearing date to shorten time for a motion to compel plaintiffs to obtain a
bond/imdertaking on appeal. After reviewing the notice, CA Construction will not require
the ex-parte hearing at this time, and therefore, requests that the ex-parte hearing be taken
off calendar. Please be advised that CA Constmction will likely file the same type of motion
when final judgment is entered on its request for costs and attorneys' fees currently pending
before the court.
