16 WHEREAS, the above-captioned complaint was filed in the Civil Department of
17 the above—captioned court on July 25, 2022.
18 WHEREAS, the Summons was issued by the clerk’s office on September 9,
19 2022.
20 WHEREAS, the defendant filed a demurrer to the complaint and motion to strike
21 portions of the complaint on November 30, 2022.
WHEREAS, the court sustained the demurrer to the complaint on January 30,
2023 based on Probate Code §17200 which provides...the probate court has

"exclusive jurisdiction over proceedings concerning the internal affairs of trusts..." and
“
eclared the motion to strike moot.
NOW THEREFORE, counsel for the plaintiff and defendant stipulate and agree
the following:
That the above-captioned complaint shall be transferred to the Probate
Department of the above-captioned court.
STIPULATION AND ORDER

Plaintiff shall be responsible for any and all costs of transfer.
That the plaintiff shall be given 20 days after notice that the complaint has been
transferred to the Probate Department to file a First Amended Petition which shall be
amended consistent with the court's ruling on the demurrer dated January 30, 2023.
