Background
Plaintiff Juanita Denise Schmittle (“Schmittle”) filed this employment action against her

16 employer Defendant Baldwin Park Unified School District (“BPUSD”). Schmittle’s Complaint
17
alleges causes of action for discrimination, retaliation, failure to accommodate, failure to engage
in good faith interactive process, and failure to prevent discrimination.

19 During the pendency of the instant case, Schmittle was charged by the Los Angeles
20 County District Attorney with worker’s compensation insurance fraud. The charges stem from a
21 report of suspected worker’s compensation insurance fraud on the part of Schmittle filed by
Sergio Cazorla (“Cazorla”), Director of Risk Management & Benefits for the BPUSD, in or
around December 2015. The charges against Schmittle have now been dismissed.

Schmittle now moves to amend the Complaint to include facts and causes of action
related to her allegedly wrongful arrest and prosecution and the alleged failure to accommodate
&
Schmittle. BPUSD opposes.
