22 This declaration is made in support of Plaintiff's Motion for Attorney Fees as the
23 Prevailing Party Against Defendant Vanalden, Inc. under Civil Code Section 789.3.
24 This attorney declaration is submitted pursuant to Code Civ. Proc. Section 473(b). Since I
25 have not been working on this case for almost three years, and there being numerous post-
26 trial motions, I have not followed the litigation more closely and was unaware of the status
27 I apologize for my inadvertence, surprise, and excusable neglect that contributed to this
