Plaintiff, DAVID C. O’BRIEN AS ATTORNEY-IN-FACT FOR TERESA E.
O’BRIEN (hereinafter “Plaintiff’), by and through her undersigned attorneys an individual, by
and through her undersigned attorneys and pursuant to Rule 1.350, Florida Rules of Civil
Procedure, hereby propounds the following Request for Production of Documents and Things upon
Defendants, AMERICA'S CHOICE TITLE COMPANY, a Florida corporation and
CHRISTINE MICIELI (jointly, “Defendants”):
I. DEFINITIONS
The following definitions apply to these Requests:
(a) The words “you” and “your” shall mean the party(s) responding to these requests.
(b) The words “document” or “documents” shall include, without limiting the
generality of the foregoing, any contracts, amendments, plans, drawings, diagrams, easements,

permits, reports, inspection reports, leases, addenda, schedules, guarantees, credit applications,

memoranda, calendar and diary entries, memoranda of conversations and of meetings, telephone
notes, studies, offers, drafts, inquiries, bulletins, brochures, summaries, newsletters, compilations,
maps, charts, graphs, photographs, film, slides, microfilm, articles, announcements, books, books

of account, ledgers, screen shots, vouchers, cancelled checks, invoices, proposals, deposit slips,

bills, opinions, certificates, and all other tangible things upon which any handwriting, typing,

printing, drawings, representation, magnetic or electrical impulses, or other form of
communication is recorded, including audio and video recordings, smart phone images and
smartphone recordings, and computer stored information.
(c) The words “person” or “persons” mean all natural persons (“individual” or
“individuals”) and entities, including without limitation: corporations, companies, limited liability
companies, partnerships, limited partnerships, joint ventures, trusts, estates, associations, public
agencies, departments, bureaus and boards.
(d) The term “communication” shall mean every manner or means of disclosure,
transfer or exchange, and every disclosure, transfer or exchange of information whether orally or
face-to-face, or by telephone, mail, personal delivery, document, or otherwise.
(e) The term “or” shall be construed either conjunctively or disjunctively to bring
within the scope of these requests any information which might otherwise be construed to be
outside their scope.

(f) The term “Property” shall mean the real property located at the address commonly
referred to as 1 Blaketon Court, Palm Coast, Florida 32137, being that same property in the General
Warranty Deed attached hereto as Exhibit “A”.
(g) The term “HUD-1 Settlement Statement” refers to that same HUD-1 attached
hereto as Exhibit “B”.
(h) The term “Closing” shall mean the closing the sale of the Property from Teobaldo

INSTRUCTIONS
1. All documents and things produced in response to this request are to be produced
in the form, order, and manner in which they are maintained.
2. If any documents and things identified in response to this request are in the custody,
possession, or control of a third party(s), state the identity and location of such party(s).
3. As to each document or thing produced, specify by number the particular
request to which it responds.
4. If any document or thing requested was at one time in existence, but is either no
longer in existence or has been lost, please state for each such document:
(1) the type of document or thing;
(i1) the author(s) or originator(s) of the document along with their address(es) and the
name(s) and address(es) of any persons who received copy(ies) or duplicate(s) of the document or
thing;
(iii) | the circumstances under which such document or thing ceased to exist or was lost;

5. If any documents or things covered by this request are withheld under claim of
privilege or immunity, furnish a list identifying each document or thing for which privilege or

You are directed to produce the documents and tangible things described in Part IV hereof,
at our office, Mercer Kutch, 2812 N. 10 St., St. Augustine, Florida 32084, within forty-five (45)
calendar days from the date of service for our review and inspection (if such day falls on a weekend

for whom the money was transferred to;
(11) Any and all instructions as to which parcel of collateral the money was to be
applied to;
(iii) Any and all confirmation of receipt by the transferee(s) of the $100,185.19;
(iv) Each and every communication to and/or from Regions Mortgage concerning
this $100,185.19 or such other amount transferred to it in connection with the
Closing;
(iv) Copies of any and all checks, front and back, if the $100,185.19 (or any
portion thereof) was paid by check as opposed to by wire to any person or
entity; and
(v) Any and all such other documentation relating to where the $100,185.19 (or
any part of it) was transferred.
2. Produce any and all statements and/or communications and/or documents of any
and all witnesses pertaining to matters related to this action, including, without limitation, any and
all statements of by you and your agents, including, without limitation, taped recordings, video
recordings, whether transcribed or not, as well as all written statements.

3. Any and all telephone message slips, notes, and/or other correspondence or

any other person or entity (excluding any correspondence that falls under attorney/client privilege)
relating to the conduct and incidents at issue in this action.
