follows:
Defendant Emad Younis’s Motion to Vacate Default Judgment is CONTINUED to October 30,
2018 at 8:30 a.m. in Department 94 to permit Defendant to address the deficiencies noted herein.
I. Background
On May 16, 2017, Plaintiff Arroyo West Homeowners (“Plaintiff”) filed this action against
Defendant Emad Younis (“Defendant”). Default was entered against Defendant on April 2, 2018;
default judgment was entered against Defendant on July 11, 2018.
On August 15, 2018, Defendant filed a Motion to Vacate Default Judgment (the “Motion”) under
CCP § 473.5 for lack of actual notice.
II. Improper Service
“Unless otherwise ordered or specifically provided by law, all moving and supporting papers
shall be served and filed at least 16 court days before the hearing. The moving and supporting
papers served shall be a copy of the papers filed or to be filed with the court.” (CCP § 1005(b).)
