SUPERIOR COURT OF THE STATE OF CALIFORNIA
COUNTY OF LOS ANGELES
Case No.: 17K05920
ARROYO WEST HOMEOWNERS ASS.,
Plaintiff, NOTICE OF MOTION AND MOTION FOR
vs. TAXING COSTS ;
EMAD YOUNIS, Date: 5/30/19
Time: 8:30 am
Defendant Dept: 94
TO ALL PARTIES AND THEIR RESPECTIVE ATTORNEYS OF RECORD:
I Emad Younis (defendant), asking the court for an order striking and/or reducing
costs requested by the other side in the asking the court for an order striking and/
or reducing costs requested by the other side in the post judgment Memorandum
of Costs dated 1/18/19 and served by mail on 1/31/19 in this case.
I request that the court strike the following item from the post judgment
Memorandum of Cost: Item number 1.a.7 for attorneys’ fees
The reasons for striking these cost item are:
1. There was no contract or statute that provided for attorneys’ fees.
2. The Plaintiff was already awarded $1,975.00 for attorneys’ fees.
3. The amount requested is Extremely excessive and varies significantly
from the amount demanded by the same Attorney for the same time period in his
letter dated 1/31/19 in which he clearly states that his fees to date are $450.
In the alternative, if the court does not strike the cost number 7 for attorneys’
fees, I request that the court reduce the cost to the above mentioned amount
demanded by same Attorney for his fees for same time period of $450.
