ANALYSIS:
On May 16, 2017, Plaintiff Arroyo West Homeowners (“Plaintiff”) filed this action against
Defendant Emad Younis (“Defendant”). Default judgment was entered against Defendant on
July 11, 2018 in the amount of $17,441.50 through May 1, 2018, attorney’s fees in the amount of
$1,975.00 and costs and disbursements in the amount of $1,189.26. (Judgment, 07/11/18.)
On January 9, 2019, the Court issued an order denying Defendant’s first Motion to Vacate.
(Minute Order, 01/09/19.) Defendant filed numerous other challenges to the judgment, including
a motion for reconsideration of the first Motion to Vacate and appeal of the order denying the
Motion to Vacate.
On April 28, 2020, the Appellate Division issued a Remittitur affirming the Court’s January 9,
2019 order denying the first Motion to Vacate Default Judgment. (Appeal – Remittitur, filed
