BART J. KLEIN hereby certifies as follows:
Iam an attorney of the State of New Jersey and counsel for plaintiff National
Building Supply Corp., a division of SRS Distribution Inc. ("National") in its action to
recover contract damages, interest and expenses. I make this certification in support of
this motion to permit service, nunc pro tunc upon the defendants NJ Home Builder &
Renovations LLC d/b/a NJ Roof And Siding LLC and Dan Sachkowsky, by way of
service by certified and regular mail, and, in the event of non-response to the Complaint
within the deadline set by the Rules of Court, to authorize entry of a default against
defendants NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC and
Dan Sachkowsky.
I. DILIGENCE IN ATTEMPTED SERVICE OF COMPLAINT
1. On September 23, 2022, I prepared the complaint in this matter and arranged
for it to be e-filed to the Clerk of the Court for filing.

2. On September 24, 2022, a copy of the filed Track Assignment Notice was
e-filed to this office.
3 On September 27, 2022, the Summonses were prepared and forwarded
to a professional process server, Status, LLC (“Status”) for service on NJ Home Builder
& Renovations LLC d/b/a NJ Roof And Siding LLC and Dan Sachkowsky. On or about
September 30, 2022, Status notified us that it was unable to make service on NJ Home
Builder & Renovations LLC d/b/a NJ Roof And Siding LLC at 2775 U.S. 9, Howell
Township, New Jersey 07731. Both the Affirmation of Non-Service for NJ Home
Builder & Renovations LLC d/b/a NJ Roof And Siding LLC and e-mail I received from
Status indicated: “9/30/22 10:22 am Attempted service at 2775 U.S. 9, Howell
Township, NJ 07731, Found it. Vehicles parked in back of mini strip mall. No on-site
office”. “9/30/22 10:33 am Attempted service at 2775 U.S. 9, Howell Township, NJ
07731, Found office inside Langans plumbing door. Office locked. Employee at
Langans advised they are never in that office and only come to pickup mail once in a
while.” A true copy of each of the Affidavit of Non-Service and the e-mail from Status,
LLC are annexed hereto as pages 1-2 of Exhibit A.
4. On or about October 10, 2022, Status notified us that it was unable to make
service on NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC and
Dan Sachkowsky at 284 Friendship Road, Howell, NJ 07731. Both the Affirmations of
Non-Service and e-mails I received from Status indicated for both NJ Home Builder &
Renovations LLC d/b/a NJ Roof And Siding LLC and Dan Sachkowsky: “9/30/2022
9:56 am Attempted service at 284 Friendship Road, Howell, NJ 07731, 4 vehicles. No
answer to ring doorbell. Someone came to door, but refused to open. No answer at
neighbors”; “10/2/2022 10:19 am Attempted service at 284 Friendship Road, Howell,
NJ 07731, Same vehicles. No answer Contact card removed”; “10/4/2022 10:39 am
Attempted service at 284 Friendship Road, Howell, NJ 07731, Same vehicles. no
answer. dog barking. Contact card removed”; “10/5/2022 7:13 pm Attempted service at
284 Friendship Road, Howell, NJ 07731, 5 vehicles. No answer. Contact card removed.

No answer at neighbors”; and “10/8/2022 7:24 am Attempted service at 284 Friendship
Road, Howell, NJ 07731, Same vehicles. No answer. Contact card removed. Neighbor
doesn’t know them”; True copies of the Affidavits of Non-Service and the e-mails from
Status, LLC as to both NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding
LLC and Dan Sachkowsky are annexed hereto as pages 3-13 of Exhibit A.
5. I then requested a postal verification for NJ Home Builder & Renovations
LLC d/b/a NJ Roof And Siding LLC at 2775 U.S. 9, Howell Township, New Jersey
07731 on October 6, 2022. The post office never returned a completed postal verification
to this office for NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC.
A true copy of the postal verification request is annexed hereto as pages 1 and 2 of
Exhibit B.
6. I reviewed the corporate status report search for NJ Home Builder &
Renovations LLC d/b/a NJ Roof And Siding LLC which indicated Dan Sachkowsky was
the agent for NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC and
the Agent/SOP Address as 2775 U.S. 9, Howell Township, New Jersey 07731. A true
copy of the corporate search is annexed hereto as Exhibit C.
7 I then attempted to check the property ownership for 284 Friendship
Road, Howell, NJ 07731 and discovered that the property was owned by Dan
Sachkowsky. A true copy of the property ownership report is annexed hereto as
Exhibit D. In addition, credit records submitted to my client in late February 2022
indicate that 284 Friendship Road, Howell, NJ 07731 is the residence of
Dan Sachkowsky.
8. Accordingly, service has at all times been diligently attempted and
pursued, consistent with the requirements of the Rules of Court.

IL SERVICE BY MAIL PURSUANT TO RULE 4:4-4 1(OGB
9. On October 11, 2022, I served NJ Home Builder & Renovations LLC d/b/a
NJ Roof And Siding LLC and Dan Sachkowsky by certified mail, return receipt
requested and simultaneously by ordinary mail pursuant to Rule 4:4-4(b)(1)(C)(3) at the
address of 284 Friendship Road, Howell, NJ 07731 for NJ Home Builder & Renovations
LLC d/b/a NJ Roof And Siding LLC c/o Dan Sachkowsky and Dan Sachkowsky. True
copies of my transmittal letters, summons and slips for certified mail are annexed hereto
as Exhibit E.
10. On or about October 15, 2022, I received the Certified Mail return receipt
card indicating that the mail which was addressed to Dan Sachkowsky at 284 Friendship
Road, Howell, NJ 07731 was received on October 13, 2022. A true copy of the executed
return receipt is annexed hereto as page 1 of Exhibit F. As the Certified Mail return
receipt card failed to indicate a signature of the Certified Mail package, I went on-line to
print out the U.S. Postal Service Track & Confirm form which indicated the Certified
Mail package was delivered on October 13, 2022 and was delivered to an Agent. A true
copy of the USPS Track & Confirm form is annexed hereto as pages 2-3 of Exhibit F.
11. On or about October 19, 2022, I received the Certified Mail return receipt
card indicating that the mail which was addressed to NJ Home Builder &
Renovations LLC d/b/a NJ Roof And Siding LLC c/o Dan Sachkowsky at 284 Friendship
Road, Howell, NJ 07731 was received on October 17, 2022. A true copy of the executed
return receipt is annexed hereto as page 1 of Exhibit G. As the Certified Mail return
receipt card failed to indicate a signature of the Certified Mail package, I went on-line to
print out the U.S. Postal Service Track & Confirm form which indicated the Certified
Mail package was delivered on October 17, 2022 and was delivered to an Agent. A true
copy of the USPS Track & Confirm form is annexed hereto as pages 2-3 of Exhibit G.

12. In addition, the regular mail packages have not been returned to me. I thus
conclude that good service has been made upon Dan Sachkowsky by regular mail
pursuant to Rule 4:4-4(b)(1)(C)(3) on or about October 13, 2022 and that good service
has been made upon NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding
LLC c/o Dan Sachkowsky by regular mail pursuant to Rule 4:4-4(b)(1)(C)(3) on or about
October 17, 2022.
II. CONCLUSION
13. Since the last known address for NJ Home Builder & Renovations LLC
d/b/a NJ Roof And Siding LLC and Dan Sachkowsky is 284 Friendship Road, Howell
NJ 07731 according to the property ownership report for Dan Sachkowsky (see
paragraph 7) (Exhibit D), and the executed Certified Mail return receipt Cards (Exhibits F
and G), it appears that this address is the current main business address for NJ Home
Builder & Renovations LLC d/b/a NJ Roof And Siding LLC and the residence address of
Dan Sachkowsky.
14. The address of NJ Home Builder & Renovations LLC d/b/a NJ Roof And
Siding LLC and Dan Sachkowsky remains available for service by mail. I respectfully
request that the Court grant leave, nunc pro tune, to permit and approve plaintiff's service
of the Summons and Complaint and Track Assignment Notice upon the defendant
NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC by certified mail.

The post office never returned a completed postal verification to this office for NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC. A true copy of the postal verification request is annexed hereto as pages 1 and 2 of Exhibit B. 6. I reviewed the corporate status report search for NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC which indicated Dan Sachkowsky was the agent for NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC and the Agent/SOP Address as 2775 U.S. 9, Howell Township, New Jersey 07731. A true copy of the corporate search is annexed hereto as Exhibit C. 7 I then attempted to check the property ownership for 284 Friendship Road, Howell, NJ 07731 and discovered that the property was owned by Dan Sachkowsky. A true copy of the property ownership report is annexed hereto as Exhibit D. In addition, credit records submitted to my client in late February 2022 indicate that 284 Friendship Road, Howell, NJ 07731 is the residence of Dan Sachkowsky. 8. Accordingly, service has at all times been diligently attempted and pursued, consistent with the requirements of the Rules of Court. True copies of my transmittal letters, summons and slips for certified mail are annexed hereto as Exhibit E. 10. On or about October 15, 2022, I received the Certified Mail return receipt card indicating that the mail which was addressed to Dan Sachkowsky at 284 Friendship Road, Howell, NJ 07731 was received on October 13, 2022. A true copy of the executed return receipt is annexed hereto as page 1 of Exhibit F. As the Certified Mail return receipt card failed to indicate a signature of the Certified Mail package, I went on-line to print out the U.S. Postal Service Track & Confirm form which indicated the Certified Mail package was delivered on October 13, 2022 and was delivered to an Agent. On or about October 19, 2022, I received the Certified Mail return receipt card indicating that the mail which was addressed to NJ Home Builder & Renovations LLC d/b/a NJ Roof And Siding LLC c/o Dan Sachkowsky at 284 Friendship Road, Howell, NJ 07731 was received on October 17, 2022. A true copy of the executed return receipt is annexed hereto as page 1 of Exhibit G. As the Certified Mail return receipt card failed to indicate a signature of the Certified Mail package, I went on-line to print out the U.S. Postal Service Track & Confirm form which indicated the Certified Mail package was delivered on October 17, 2022 and was delivered to an Agent.
