The court .has before it an order to show cause for, inter
alia, a restraining order and stay of the proceedings. The
aforementioned documents are hereby returned to the respondent,
without signature.
By decision and order dated August 16, 2010, this court held
that respondent is statutorily entitled to a stay pursuant to CPLR
5519(a) (6), provided that she submit an undertaking in the amount
of S2, 400 per month, payable to Raymond E. van swienen, as trustee
of the William H. Van Zwienen Revocable Trust. The aforementioned
respondent'
decision and order specifically stated that s requested
stay would take effect conditional. upon her payments. To date,
respondent has failed to provide any such undertaking.
Furthermore, the court has before it a pending motion from
respondent to renew and reargue the August 16, 2018 decision and
order. Accordingly, the court cannot entertain her current
application requesting the same relief .
This decision constitutes an order of this court.
