INTRODUCTION 20 Plaintiff, ALANAH STONE, moves this Court for an order denying defendant’s 21 Motion for Nonsuit on the grounds that Plaintiff has presented more than sufficient 22 evidence of causation. 23 The evidence presented on behalf of plaintiff is overwhelming. There is more than 24 sufficient evidence in this case for a jury to find for Plaintiff. 25 A nonsuit in a jury case is only proper under very restrictive circumstances, such 26 as when interpreting the evidence in the plaintiff’s favor and resolving all presumptions, 27 inferences and doubts in favor of the plaintiff, it can be said that a judgment for the 28 defendant is required as a matter of law. 1 OPPOSITION TO MOTION FOR NONSUIT
