the Defendants, THE VILLAGE OF ROCKVILLE CENTRE and MICHAEL E. OSWALD, are
hereby requested to furnish the undersigned, as attorney for the plaintiff within twenty (20) days
after the service hereof, sworn admission of the following:
1. At the time the underlying accident occurred, Cedar Avenue at or near its
intersection with Hempstead Avenue, in the County of Nassau, State of New York, was and still
is a public roadway over and along which motor vehicles were accustomed to and did travel.
2. At the time the underlying accident occurred, at the aforementioned location, the
2016 Chevrolet motor vehicle bearing New York State license plate number AY8768 operated by
Defendant, MICHAEL E. OSWALD, came into contact with the 2013 BMW motor vehicle,
operated by Plaintiff, ROBIN ELLIS. (Annexed hereto is a copy of the certified police report).
