                           1. I am the attorney of record for all remaining Plaintiffs in this matter. This declaration is based

                                 on my personal knowledge.

                           2. This case is still on Appeal. Plaintiffs have filed their Opening Brief and the Respondents’ Brief

                                 is due March 3, 2023. By the time this hearing takes place, the Respondents’ Brief will likely
             25                  have been filed.
             26            3. Plaintiff have dismissed the Appeal as to Defendant American Dream Fund, LLC and SLS
             27                  Tranche 1 Lender, LLC. The only Defendant remaining on the Appeal is Defendant Las Vegas

             28                  Resort Holdings, LLC.
