denied. The only exigency that exists in this case is a result of Defendants’ delay. Their motion
was filed on August 19, 2019 with a hearing date of May 13, 2020. The trial was already set for
June 15, 2020. Despite knowledge of the trial date, Defendants waited approximately six months
to request an earlier date. Clearly defendants understood as early as August 19, 2019 that this
motion had to be advanced, and to wait six months to request an advancement is fatal to the ex
parte application.
