Marie S. Weiner, Dept. 2 vs. ORDER LIFTING STAY and SETTING COURT TRIAL TIM ONDERKO, et al., Defendants. On April 18, 2023, a Case Management Conference was held in Department 2 of this Court before the Honorable Marie S. Weiner. Donald Wilson appeared on behalf of Plaintiffs and Wes Ehlers, Esq. specially appeared on behalf of Plaintiffs; and Dominic Signorotti, Esq. appeared on behalf of Defendant. Counsel for the parties reported that they participated in a mediation in February 2023, and that the case did not settle. Counsel for the parties agreed to proceed with Court Trial of the sole issue of Declaratory Relief. Counsel estimated that the Court Trial would take one-half day. The Court made the following rulings at the Conference, which are set forth herein as the formal order of the Court. IT IS HEREBY ORDERED: ALL STAYS ARE LIFTED. Defendant shall file and serve an Answer to the First Amended Complaint on or before May 10, 2023. Pursuant to request of counsel for the parties, this action is set for Court Trial on the sole cause of action for Declaratory Relief.
