Memorandum of Law in Support, and the exhibits annexed thereto, Plaintiff will cross-move this
Court, before the Honorable Alexander M. Tisch, J.S.C., at the Courthouse located at 360 Adams
Street, Brooklyn, New York 11201, on July 28, 2023, at 9:30 a.m., or as soon thereafter as counsel
may be heard, for an Order:
(1) denying Father Acciarito’s motion because his arguments are without merit; and
(2) granting Plaintiff’s cross-motion for sanctions against Father Acciarito’s counsel for
her willful and contumacious effort to delay his deposition; and
(3) for such other and further relief that this Court may deem just and proper.
PLEASE TAKE FURTHER NOTICE that pursuant to CPLR 2214(b), responding
affidavits, if any, are required to be served upon the undersigned at least one (1) day before the
return date of this cross-motion.
