No 18 opposition papers were filed. 19 DISCUSSION 20 Defendant Susan Nakagama (“Defendant”) moves the court for an order continuing trial 21 and all related dates in this action to March 1, 2024. @ 22 Defendant contends that a continuance is warranted because (1) she filed a Notice of Sad he 23 Appeal on August 5, 2022, appealing the court’s June 22, 2022 order denying her special motion me 24 we to strike the Third Amended Complaint, and the appeal is currently pending, and (2) Defendant 25 died on November 11, 2022, and the Attorney General’s Office will soon be able to substitute the 26 Estate of Susan Nakagama as defendant in this and the appellate matters once the Letters of 27 Administration are issued by the probate court. 28 The court grants in part and denies in part Defendant’s motion as follows. 1
