              22           PLEASE TAKE NOTICE that Plaintiff Mercury Insurance Company (“Plaintiff”),

              23   hereby brings this motion for an order granting terminating sanctions and thereby striking

              24   the answer by Defendant Michel Gomez ("Defendant"). In the alternative, Plaintiff will ask

              25   for evidentiary sanctions to preclude Defendant from testifying at trial.

              26           The Motion to Compel has been set for hearing on July 24, 2018, at 8:30 a.m., or

              27   soon thereafter as the matter may be heard in Department 94 of the above—entit|ed Court.
