SUPERIOR COURT OF CALIFORNIA, COUNTY OF LOS ANGELES Civil Division Central District, Stanley Mosk Courthouse, Department 74 BC711090 May 2, 2019 JAMES R MELVILLE ET AL VS OLYMPUS AMERICA INC 8:30 AM ET AL Judge: Honorable Michelle Williams Court CSR: None Judicial Assistant: C. Guerrero ERM: None Courtroom Assistant: P. Rees Deputy Sheriff: None APPEARANCES: For Plaintiff(s): Michael Albert Kelly by Conor M. Kelly (Telephonic) For Defendant(s): Mark E. Anderson by Keola Whittaker; Roy Chuck Manukyan (Telephonic) NATURE OF PROCEEDINGS: Hearing on Motion to Seal Motion to File Confidential Documents under Seal The matter is called for hearing. Counsel submit on the tentative ruling which is adopted as the Order of the Court as follows: The Motion re: Motion to File Confidential Documents Under Seal filed by Olympus Corporation of the Americas, Olympus America, Inc. on 02/13/2019 is Granted. Courts must find compelling reasons, prejudice absent sealing and the lack of less-restrictive means, before ordering filed documents sealed. (McGuan v. Endovascular Technologies, Inc. (2010) 182 Cal.App.4th 974, 988, “the protection of trade secrets is an interest that can support sealing records . . . .”.) A proposed sealing must be narrowly tailored to serve the overriding interest, such as by sealing portions of pleadings or redacting particular text. (In re Marriage of Burkle (2006) 135 Cal.App.4th 1045, 1052, 1070.) Plaintiff has established that the information to be sealed is confidential corporate information. The redacted portions of the documents are narrowly tailored to seal only the portions of the documents containing the information, and redacted copies were publicly filed. The motion is granted. Notice is waived. Minute Order Page 1 of 1
