PLAINTIFF’S MOTION TO TRANSFER VENUE
COMES NOW the Plaintiff, CLIFTON JUSTIN, by and through her undersigned counsel,
pursuant to Florida Rule of Civil Procedure 1.060, request this Court to transfer venue to Osceola
County and in support thereof states:
1 Plaintiff filed her Complaint in Wakulla County on March 21, 2023.
2 The Complaint was mistakenly filed in Wakulla County and proper venue lies in
Leon County, Florida.
3 Pursuant to Florida Rule of Civil Procedure 1.060(b), "when any action is filed laying
venue in the wrong county, the court may transfer the action in the manner provided in Rule 1.170(j)
to the proper court in any county where it might have been brought..."
4 As required by Rule 1.170(j), Plaintiff will satisfy the Leon County Circuit Court's
service charge.
5 No prejudice will occur to the Defendants by virtue of transferring venue of this matter
to Osceola County.
WHEREFORE, Plaintiff respectfully requests that this Court transfer her claim to Leon
County, Florida for proper venue.
