In connection with the Status Conference scheduled for December 18, 2019 counsel for
defendant should be prepared to cite any cases holding that a union employee is inadequate to
represent a class of non-union employees in a wage and hour class action. Plaintiffs' counsel
shall be prepared to cite any cases holding that union employees are adequate to represent non-
union employees in a wage and hour class action.
Further counsel shall be prepared to discuss whether the named plaintiffs' claims are typical in
light of their union membership. Gonzales v. San Gabriel Transit, Inc. (2019) 40 Cal.App.5th
1131, 1161-1162.
Pursuant to Government Code sections 68086, 70044, California Rules of Court, rule 2.956, and
the stipulation of appearing parties, Keri Logan, CSR#12608, certified shorthand reporter is
appointed as an official Court reporter pro tempore in these proceedings, and is ordered to
comply with the terms of the Court Reporter Agreement. The Order is signed and filed this date.
Further Status Conference is held.
Court and counsel confer regarding discovery issues.
Defendant is ordered to produce the handbooks to Plaintiff, forthwith and no later than
1/10/2020.
Hearing on Motion to Strike Class Allegations is scheduled for 04/06/2020 at 09:00 AM in
