                                    APPLICATION AND ORDER FOR PUBLICATION

The Application and Order for Publication for                “The Testate and Intestate Successors of Juan Garcia Mendez.                     ”    is being rejected
and the documents are returned for the following reason(s)

 x.      1.    Provide facts and evidence to substantiate the need to serve by publication, in order to satisfy the requirement of
         diligence (Code Civ. Proc.,             §§ 415.20, 415.30, and 415.50):
         _X__a.      Investigate (attempt to serve, check for forwarding address at the post office, etc.) all addresses and phone
         numbers (call each number) that have been valid for the last 2 years.                       Demonstrate search of decedent’s possible intestate
         successors;        the three factors cited are insufficient (Memo.          P&A,     p. 2:3-6.).
                 b. Ch eck internet pages of service providers that provide data for locating people. (Intelius, Spokeo, etc). Investigate results.
         Attach printouts        from the search.
                 c. Provide process server's declaration for any attempted service(s) of process.
                 d. Check real property ownership records. Please investigate results and explain.
               e. Check the local post office for change of address info. Submit a form to the post office and return stamped form. (Copy attached)
         2. Submit a declaration,        by a person with personal knowledge regarding the searches.
         3. Use the Court forms for Application and Order. (Copy attached).                 Submit separate Application and Order for each Defendant.
         4. Mail a copy of the Summons and Complaint (or Petition) to defendant's last known address by REGULAR FIRST CLASS MAIL.
              pursuant to CCP § 415.30,          and submit a declaration attesting to that fact.
         5. Provide print-outs       of the searches and submit them with an original set of documents and one copy set of documents.
         6. For Quiet Title and Eminent Domain actions:
         a. The Order must reference the following: post a copy of the summons and complaint;                    record a notice of pendency (CCP §
      763.020 (Quiet Title only)); and describe the property (i.e.,          APN,   county, etc.) on the Order for Publication (LACIV 145) on the order
      (written on the order above the signature of the judicial officer.) Moving party must also state that the requirements will be complied
      with.
         b.    CCP § 762.060: (a) How to name unknown defendants; (b) Defendants known with an adverse claims or reasonably apparent
  @      from an inspection must be named.

enyélope in order to return one confirmed copy to you. Please DO NOT include more than one copy of any document to be conformed.
