As a result, your scheduled hearing will be conducted by phone. At least 2-3 days before your hearing, you must call the Gadsden County Small Claims Clerk's office at 850-875-7050 and leave a current phone number. at the time of your scheduled hearing or as soon thereafter as possible you will receive a call and your hearing will be conducted. Please note that some of you will receive a call from our mediation office and they will conduct mediations at the time of your scheduled hearing. Again, please do not wait until the day of court to leave your number. Law Firm Special Instructions: You must email the Gadsden County Small Claims Clerks' office within 2- 3 days of the scheduled hearing to provide a DIRECT PHONE NUMBER where you can be reached. For your information, | am forwarding Judge Garner's preferred procedures regarding submission of proposed orders, setting hearings and court appearance methods: Setting Hearings: Unless it is a trial or a hearing that will take more than 30 minutes, our clerks set these on the next available dockets unless you specify it needs to be set out a certain amount of time ie, set after 2 months. If more than 30 minutes is necessary or the matter is ready for trial, our office will set those. Proposed Orders: Initially email the order to my attention. Once Judge Garner has reviewed and executed the order, it will be e-filed and you may then send envelopes to our office for processing. To ensure the envelopes correspond with the case, please include a cover memo which includes the case style. In the alternative, you may choose to include a signed copy of the order. In any event, please do not email the proposed order and then mail a blank order as this creates duplicity issues. In cases where both sides are represented by attorneys, envelopes are not necessary since both will receive the orders via email. Hearing Appearance Methods: Judge Garner will continue to allow telephonic appearances for short(30 minutes or less) hearings. For matters that are more complicated and wherein witness testimony is required, Zoom will be used. Non-jury trials will be conducted in-person unless the parties agree Zoom is feasible.
