Budget Wireless California, LLC BC719426 3’ D,,.,,, CASE MANAGEMENT ORDER The court has read the Joint Initial Status Conference Response previously led and issues the following Case Management Order: . 1. The defendant indicates in the above Joint ISC Response that the plaintiff signed g . an agreement to arbitrate claims. The plaintiff contests that the agreement is enforceable. 2. The Court partially lifts the stay previously imposed to permit a hearing on a defense motion to compel arbitration. This motion is to be led within thirty days. Defendant is to call the Court prior to ling to get a hearing date and brieng schedule for this motion. The parties may conduct discovery on the arbitration . issue only. The Court sets a non-appearance review for March 1, 2019. If no motion is led by noon on two days before, the defendant is ordered to le a declaration indicating the status of the arbitration motion. _ 3. Discover will be phased with the stay lifted pursuant to the above paragraph. Class Certication and Merits-based discovery remains stayed pending the V Court’s ruling on the Motion to Compel Arbitration.
