Montoya (BC722093) – Ex Parte Application to Increase Page Limit for Joint Opposition to Motion for New Trial / JNOV Plaintiff moves ex parte for an order: (1) permitting Plaintiff to submit a joint opposition to Defendant’s motion for new trial and motion for judgment notwithstanding the verdict; and (2) permitting the joint opposition to exceed the page limit by 4 or 5 pages to reduce overlapping opposition filings. (3) Plaintiff would permit Defendant to increase their page limit by five pages. Plaintiff already submitted the over-length joint opposition on June 15, 2020, without leave of court. It appears Plaintiff did so after Defendant filed a reply requesting the court to strike the opposition for failure to adhere to the 15-page limit on June 18, 2020. Plaintiff’s grounds are that a joint opposition reduces the need to file duplicative briefs with duplicative exhibits, and reduces the overall volume of filings, even though the brief would need to be increased by four pages. An opposition may not exceed 15 pages. (Cal. Rules of Court, Rule 3.1113(d).) A party may apply ex parte for permission to file a longer memorandum. (Id. at (e).) The application must state reasons why the argument cannot be made within the stated limit. (Id.)
