1. Upon approval by the New York State Department of Health and Publio Health and
Health Planning Council of the Application for Delaware Operations Associates LLC will
become the permanent operator of the residential health care facility now known as Delaware
Nursing and Rehabilitation Center, located at 1014 Delaware Avenue, Buffalo, New York. I
am the managing member of Delaware Operations Associates LLC, which shall be located at
1014 Delaware Avenue, Buffalo (Brie County), New York 14209 (hereinafter refened to
as the "Pmmises").
2, Upon approval, Delaware Operations Associates LLC will lease the Premises from
Delaware Real Property Associates LLC, the proposed owners of the Premises, through an
Agivement of Lease.
