SUPERIOR COURT OF CALIFORNIA, COUNTY OF LOS ANGELES
Civil Division
Southwest District, Inglewood Courthouse, Department 8
19IWSC01122 March 5, 2020
JOHN SANTNER vs WAYNE COX 8:30 AM
Judge: Honorable Ronald F. Frank CSR: None
Judicial Assistant: N. Rodriguez ERM: Proceedings Electronically Recorded
(FTR)
Courtroom Assistant: None Deputy Sheriff: Deputy, G. Gayles
APPEARANCES:
For Plaintiff(s): No Appearances
For Defendant(s): Wayne Cox
NATURE OF PROCEEDINGS: Non-Jury Trial
Cause is called for hearing re: Small Claims Court Trial at 9:54 a.m.
Wayne Cox (Defendant) is present and sworn.
No appearance by or on behalf of the plaintiff. (Note: the plaintiff, Mr. Santner, placed a
telephone call to Department 8 to advise of his failure to appear due to illness.)
On the Court's own motion, the Non-Jury Trial scheduled for 03/05/2020 is continued to
07/21/2020 at 08:30 AM in Department 8 at Inglewood Courthouse.
Mr. Cox indicates that his no-asset Chapter 7 bankruptcy case does not require him to schedule
the Plaintiff's claim in order to be discharged. Defendant did present an order of discharge, but
Section 523 of the Bankruptcy Code lists certain exceptions to the dischargeability. The parties
should be prepared at the continued trial to address these issues and whether plaintiff's claim
does or does not fit withing the definition of exception to discharge.
