The tentative ruling has been posted online for counsel to review. After hearing argument from counsel, the Court adopts its tentative ruling as the Order of the Court as follows: The Motion to Compel Defendant's Responses to Request for Production of Documents, Set Five and Request for Sanctions filed by Jorge Polzin on 03/02/2021 is Denied. Plaintiff moves for an order compelling further responses to request for production, set five. Standard Pursuant to CCP § 2024.020 “[e]xcept as otherwise provided in this section, any party shall be entitled as a matter of right to complete discovery proceedings on or before the 30th day, and to have motions concerning discovery heard on or before the 15th day, before the date initially set for the trial of the action. Except as provided in subdivision (e), a continuance or postponement of the trial date does not operate to reopen discovery proceedings.” This motion is untimely. Trial was originally scheduled for February 16, 2021, meaning that any discovery motion should have been brought by February 1, 2021. (Chan Decl., ¶ 14) Plaintiff filed the instant motion on March 2, 2021, past the motion cutoff date. Though the Court continued trial to June 14, 2021, it did not continue the discovery cutoff date.
