IT IS HEREBY ORDERED as follows:
         1     Pursuant to CRC Rule 3.300, the case of Onderko v. Wilson 22CIV02332

is deemed a Related Case to Golden Global Enterprises, Inc. v. Onderko 22CIV02099,

and is single assigned for all Purposes to Department 2, Honorable Marie S. Weiner, who

is the single assigned judge for the earlier filed case of 22C1V02099.

        2.     A Case Management and Trial- Setting Conference is hereby set in both

cases for Tuesday, January 10, 2023 at 9:00 a.m. in Department 2 of this Court. The

Case Management Conférence set for December 15, 2022 in the Department of the Civil

Commissioner is VACATED.         The parties shall proceed with ADR in 22CIV02322 as

previously agreed’and ordered.



        THE COURT FINDS as follows:

        The case of Golden Global Enterprises, Inc. v. Onderko 22CIV02099 was filed

on May 24, 2022, and assigned for all purposes to Department 2; Hon. Marie S. Weiner.

        The case of Onderko v. Wilson 22102332 was filed on June 8, 2022, and

assigned for all-purposes to Department 23, Hon. V. Raymond Swope.

        On September 13, 2022, counsel for Onderko filed a Notice of Related Case in

22C1V02332, and served it upon counsel for Donald Wilson. No one filed any Response

to the Notice of Related Case, pursuant to CRC Rule 3.300(g), contesting that the cases

are related.

        On October 3, 2022, Donald Wilson filed-a Notice of Related Case in

22C1V02099, after this Court issued an Order questioning why one had not yet been.

filed. No one filed any Response to thie Notice of Related Case contesting that the cases

are related.

       A review of the cases reflects that all of the parties in 20c1Vv02332 are also

parties ia 22CIV02099, have common issues of law and fact, are based on the same or

similar claims, arise from the same or substantially identical transactions, incidents, or

events; involve claims regarding the same property and business transactions; and is

likely for other reasons to require substantial duplication of judicial resources if heard by

afferent judges. The Court finds under CRC Rule 3.300 that these cases are “related”.

       The Court finds that 22CIV02099 is the earliest filed case and that it was

previously single assigned for all purposes to Department 2, Hon. Marie Weiner.

Pursuant to CRC Rule. 3.300(h)(1)(A), this Court is empowered and authorized to

“determine whether the cases must be ordered related and assigned to his or her

department”.
