PLAINTIFF’S FIRST REQUEST FOR
ADMISSION TO DEFENDANT, CHRISTOPHER LUCZYWO
Pursuant to Florida Rule of Civil Procedure 1.370, Plaintiff, First 2 Aid EMS, Inc., through
undersigned counsel, requests that Defendant, Christopher Luczywo, admit the following requests in
writing within the time limits prescribed by the Florida Rules of Civil Procedure.
DEFINITIONS
The following definitions apply to these requests for admission:
1. “Complaint” means the Complaint in this action that Plaintiff, First 2 Aid EMS, Inc., filed
on August 4, 2022.
2. “Luczywo,” “You,” or “Your” shall mean Defendant Christopher Luczywo, his heirs,
legatees, executors, personal representatives, employees, agents, partners, representatives, consultants,
accountants, and attorneys, including any person who served in any such capacity at any time during the
Relevant Time Period (as defined below).
3. “Plaintiff” or “First 2 Aid” means Plaintiff, First 2 Aid EMS, Inc., in the above-captioned
action.
4. “Relevant Time Period” means the period from July 1, 2020 up to and including the
present day.
5. “Document” means any written or graphic matter or other means of preserving thought or
expression from which information can be processed or transcribed including, without limitation, all
writings, drawings, graphs, charts, photographs, sound recordings, images, and other data or data
compilations, including electronically-stored information, that are stored in any medium whatsoever from
which information can be obtained either directly or, if necessary, after translation by the responding party
into a reasonably usable form, as well as any tangible things. A draft or non-identical copy of a document
is a separate document within the meaning of this term. A document includes all appendices, schedules,
exhibits, and other attachments. The term “Document(s)” also includes but is not limited to emails and
other types of messages (including but not limited to text, instant, and direct messages), social media or
other online content, geolocation data, data generated and stored by devices connected to the Internet of
Things, communications generated and stored in workplace collaboration tools or ephemeral messaging
applications, and all associated data and metadata.
6. “Relate,” “related,” or “relating” means, in addition to their usual and customary
meanings, concerning, referring to, reflecting, regarding, pertaining to, addressing, discussing, alluding
to, describing, evidencing, constituting, or otherwise having any logical or factual connection with the
subject matter addressed.
7. The words “and” and “or” shall be construed disjunctively or conjunctively to bring within
the scope of each request for admission all responses which otherwise might be construed to be outside
the scope of a request for admission.
8. The terms “all,” “any,” or “each” encompass any and all of the matters discussed.
9. The use of singular form includes plural and vice versa.

INSTRUCTIONS
1. Unless you properly object to the entire request, you must, under Florida Rule of Civil
Procedure 1.370(a), respond to each RFA in one of the following ways:
(a) Admit the request in its entirety.
(b) Deny the request in its entirety.
(c) Provide a qualified admission to the request. If part of an RFA is true, your answer
must specify which parts of the RFA you admit and deny (see Winn Dixie Stores, Inc. v. Gerringer,
563 So. 2d 814, 816 (Fla. 3d DCA 1990)).
(d) Object to the request in part and admit or deny the remainder.
(e) Assert a lack of knowledge or information sufficient to answer or deny the request
only if you also state that you made a reasonable inquiry and the information you know or can
readily obtain is insufficient to allow you to admit or deny the request.
(f) State in detail the reasons why you cannot truthfully admit or deny the request.
2. If you do not respond to each of these requests within the permitted time period, the
requests will be deemed admitted under Florida Rule of Civil Procedure 1.370.
3. Under Florida Rule of Civil Procedure 1.280(i), you must include the text of the original
request before your response.
4. If you object to or refuse to answer any request based on privilege or work product, provide
the following information:
(a) the type of privilege or protection claimed;
(b) the person who made the communication, whether oral or in writing;
(c) the recipient of the communication;

(d) if the communication was oral, any additional persons present when the
communication was made;
(e) if the communication was written, the author, addressees, and any other recipients;
(f) the date of the communication; and
(g) the subject matter of the communication.
REQUESTS FOR ADMISSION
1. Admit that you currently have no ownership interest in First 2 Aid EMS, Inc.

attached as Exhibit 1.

3. Admit that on July 7, 2022, First 2 Aid demanded that you return the items listed in Exhibit
A to Ted Motheral’s July 7, 2022 letter.

4. Admit that the items listed as Exhibit A in the July 7, 2022 letter from Attorney Ted
Motheral are the property of First 2 Aid.

5. Admit that you received the Civil Theft Notice, which is attached as Exhibit 2.

of First 2 Aid.

9. Admit that you borrowed money from Wayne and Barbara Luczywo during the Relevant
Time Period.

during the Relevant Time Period was for First 2 Aid’s expenses.

11. Admit that the money you borrowed from Wayne and Barbara Luczywo during the
Relevant Time Period was used by you for expenses unrelated to First 2 Aid.

12. Admit that your employment with First 2 Aid was terminated on June 8, 2022.

13. Admit that on June 8, 2022, you informed the employees of First 2 Aid that you were no
longer an owner of First 2 Aid.

14. Admit that the email attached as Exhibit 3 is genuine.

15. Admit that after June 8, 2022, you registered a corporation called “First 2 Aid, Inc.”

16. Admit that after your employment with First 2 Aid ended, you contacted at least one of
First 2 Aid’s existing contractual partners.

17. Admit that after your employment with First 2 Aid ended, you continued to hold yourself
out as a representative of First 2 Aid.

18. Admit that in August of 2022, you issued a letter to Medicare/Medicaid terminating First
2 Aid’s relationship with those programs.

Re: First2Aid EMS, Inc. –Proposed Settlement with the Company
Dear Chris:
This firm is counsel to First2Aid EMS, Inc., a Florida corporation (“F2A” and the
“Company”). It has come to my attention that you need to return certain material items that are
central to the Company’s operation back to the Company, and you also need to provide for and pay
back certain unauthorized expenses and financial transactions in which Company funds were used, as
well as to stop materially interfering with the Company’s ongoing operations. The material items, as
noted above, are specifically set forth in Exhibit A attached hereto and incorporated herein, while the
unauthorized expenses and financial transactions, as well as certain material interferences to the
Company, as also noted above, are specifically set forth in Exhibit B attached hereto and
incorporated herein.
The Company will expect you to confirm this information and agree to return the material
items to the Company’s possession, as well as agree to pay back the unauthorized expenses and
financial transactions, as well as to stop materially interfering with the Company’s ongoing
operations upon a mutually agreed upon timeline. Once an agreement is in place, I will draft a
Settlement Agreement and Mutual Release between the relevant Parties.
It is imperative that the Company gets a written or verbal confirmation that you are amenable
to this plan in order to settle these matters in an amicable and satisfactory manner. Once the
Company confirms that you are, in fact, amenable to this plan, then I will draft the Settlement
Agreement and Mutual Release in short order.
If I do not hear that you are willing to do this by the close of business (5:00 pm eastern
time) on Monday, July 11th, then I have been instructed to move forward to properly enforce any
and all legal rights that the Company has available to them, which include but are not limited to
criminal charges for theft and fraud, civil charges for tortious interference of a business, and any
other rights and remedies available to the Company at law and in equity.

Dear Mr. Luczywo:
Our firm has the pleasure of representing First 2 Aid EMS, Inc. (“First 2 Aid” or the
“Company”) with regard to this matter. If you are represented by counsel in this matter, please
promptly forward this letter your counsel’s attention.
Upon information and belief, you have committed unlawful taking of the Company’s
property in violation of Florida law. Accordingly, the Company is entitled to treble damages,
applicable interest, and reasonable attorneys’ fees and costs. In accordance with Fla. Stat. §
772.11(1), the Company hereby demands that you pay the Company the sum of $59,103.93, which
is three times the amount of damage your unlawful taking has caused the Company.
Attached as “Exhibit A” is a detailed list of the property items you have unlawfully taken
that belong to the Company.
The total estimated value of the property outlined in Exhibit A is $19,701.31. The treble
damage amount is $59,103.93.
Section 772.11, Florida Statutes, allows you thirty (30) days from receipt of this letter to
comply with the Company’s demand for $59,103.93. If you comply, the Company will provide
you a written release from all further civil liability for this act of civil theft. However, if you do
not comply or otherwise resolve this matter, the Company will proceed with legal action to recover
its treble damages ($59,103.93). If the Company is forced to take this legal action, the Company
will seek all applicable interest, attorneys’ fees, and costs in addition to the treble damages amount.
