COMPLAINT IN EMINENT DOMAIN
1 Plaintiff, COUNTY OF RIVERSIDE ("County") alleges as follows:
2 Power of Eminent Domain
3 I. The County is a body corporate and politic of the State of California.
4 2. The County does now have, and at all relevant times has had, authority to acquire real
5 property pursuant to, inter alia, Article 1, section 19 of the California Constitution; California
6 Government Code section 25350.5; and Part 3, Title 7 of the California Code of Civil Procedure,
7 including, Code of Civil Procedure sections 1240.010, 1240.020, 1240.030, 1240.040, 1240.310,
8 1240.320, 1240.110, 1240.4 I 0, 1240.420, 1240.510 and 1240.610.
9 Resolution of Necessity
3. The County has given proper, timely notice, pursuant to Code of Civil Procedure section
11 1245.235, of a hearing of the County's Board of Supervisors, duly and regularly convened on February
12 28, 2023. At that hearing, the County, pursuant to Code of Civil Procedure sections 1245.210 and
13 1245.270, duly and regularly adopted, by a vote ofno less than four-fifths of all its members, Resolution
14 No. 2023-062 entitled "Authorization to Adopt a Resolution of Necessity for the Market Street Bridge
15 Replacement Project" ("Resolution") attached to the accompanying Declaration of Mark Lancaster as
16 Exhibit "1" and incorporated herein by reference.
17 4. Pursuant to the Resolution, the County seeks to acquire County Parcel Number 0528-003A
I8 [for a Permanent Slope Easement]; and 0528-003B [for a Temporary Construction Easement] located in
19 the County of Riverside, State of California and more particularly described in Exhibit "I" attached hereto
20 ("Property"). The County determined it is necessary and it is authorized to acquire the Property to allow
21 for the replacement of the existing 2-lane bridge over Santa Ana River with a new 4-lane bridge. The new
22 bridge will have one (1) twelve-foot-wide and one (I) fourteen-foot-wide traffic lane in each direction;
23 two (2) new eight-foot-wide shoulders striped as Class II bicycle lanes; and one (I) new twelve-foot-wide
24 multi-purpose path protected by a traffic barrier on the east side of the bridge ("Project"). At the hearing
25 on the Resolution, the County further found and determined, and in the Resolution declared, that:
26 a. The public interest and necessity require the Project;
27 b. The Project is planned and located in the manner that will be most compatible with
28 the greatest public good and least private injury;

c. Acquisition of the Property is necessary for the Project; and
2 d. The offer required by Government Code section 7267.2 has been made to the
3 owners of record.
4 5. A legal description and map plat depicting the Property can be found m Exhibit "I"
5 attached hereto.
6 More Necessary Public Use
7 6. To the extend the Property is already devoted to a public use, the County alleges in the
8 alternative:
9 a. That the use for which the County is acquiring the Property is a compatible use
10 under Code of Civil Procedure section 1240.510; and
11 b. The County's use of the Property is a more necessary public use under Code of
12 Civil Procedure section 1240.610, which will not unreasonably interfere with the
13 continuance of the public use to which the Property may already be devoted under
14 the provisions of Code of Civil Procedure section 1240.630, subdivision (a).
15 The Parties
16 7. The County is informed and believes, and on that basis alleges:
17 Each of the named Defendants has occupied the Property, appears in the record as claiming an
18 interest in the Property, or is known by the County and/or believed by the County to have or claim an
19 interest in the Property described. For the convenience of the Court and parties, and not as allegations to
20 which the County intends to be bound, the County has set out opposite each of the following named
21 Defendants a statement of the respective interest of such Defendant in the Property.

9 Property, the exact nature of which is unknown to the County. The true names or capacities whether
1o individual, corporate, associate or otherwise, of Defendants DOES 1 through 100, are unknown to the
11 County, who therefore sues these Defendants by such fictitious names. The County will seek leave to
12 amend this Complaint in Eminent Domain to reflect their true names and capacities when they have been
13 ascertained.
14 9. The County is informed, believes, and thereon alleges, that each Defendant named herein
15 who is served with a copy of the Summons and this Complaint, and who fails to respond to the Summons
16 and Complaint within the time provided by law, claims no interest in the Property and is not entitled to
17 any compensation herein.
18 WHEREFORE, Plaintiff, COUNTY OF RIVERSIDE prays for judgment as follows:
19 I. That the Property herein described be condemned to the County's use for the purposes set
20 forth herein;
21 2. Compensation be ascertained and assessed and the amount of the award for the Property
22 first be determined between the County and all Defendants claiming an interest in the Property;
