21          WHEREAS,        the parties each wish to file a motion for summary adjudication of
22   Plaintiff's seventh cause of action for enforcement of judgment.
23          WHEREAS,        the parties believe it will be most efficient and in the interests of justice t
24   have the motions presented to the Court and heard together.
25          WHEREAS, the parties wish to have the motions filed and heard on a schedule

26   convenient to both parties.

27          WHEREAS, the parties waive objection to untimeliness of all moving, opposing, and

28   reply papers.

It is hereby STIPULATED by and between the parties through their attorneys of

         record that Plaintiff's Motion for Summary Adjudication of the Seventh Cause of Action and

         Defendant's Motion for Summary Adjudication of the Seventh Cause of Action shall be

         heard on December 7, 2015 at 9:30 a.m.           in Department 501 of the above Court.

     5            It is further STIPULATED that the moving papers shall be filed and served no later

     6 || than October 7, 2015,      the oppositions shall be filed and served on November 16, 2015,   and

         reply briefs on November 23, 2015.

                  It is further STIPULATED that this stipulation can be signed in counterparts and

         facsimile signatures will be equally effective as original signatures.
