Defendant to answer within 20 days. Plaintiff to give notice. STATEMENT OF THE CASE This case arises out of a dispute over insurance indemnity policies and a related cost-sharing agreement. On 05/01/2020, Plaintiff Nationwide Indemnity Company (“Plaintiff” or “Nationwide”) filed its First Amended Complaint (“FAC”) against Defendant St. Paul Fire and Marine Insurance Company (“Defendant” or “St. Paul”). The FAC also named The Travelers Indemnity Company (“Travelers”) as a defendant but the Clerk entered Plaintiff’s request to dismiss Travelers as a defendant without prejudice on 05/29/2020. Plaintiff’s FAC refers to St. Paul as “Travelers” and alleges St. Paul is Travelers’s predecessor. (See FAC, ¶¶ 3, 9.) Thus, the FAC operates under the assumption that Defendant and “Travelers” are the same legal entity. Plaintiff asserts the following causes of action against Defendant St. Paul: 1.
