COLLINS III objects to and opposes the ex parte application of 19 Defendant DEAN C. LOGAN, registrar of voters for Los Angeles County, which contains no 20 emergency grounds for ex parte relief. 21 I 22 THE MINUTE ORDER DATED 9/16/2021 EXPRESSLY STATED THE 23 ELECTION CONTEST WAS DISMISSED WITHOUT PREJUDICE 24 The written tentative decision of this Court of 9/16/2021 on Defendant’s Demurrer did 25 not specify whether the dismissal, which was without permitting Plaintiff any leave to amend, was with or without prejudice. However, the Minute Order from that date did include the 26 statement that the dismissal was without prejudice. It appears that this Honorable Court 27 considered the issue and inserted the ruling in the Minute Order that this particular dismissal was 28 without prejudice. This ex parte application seeks to change the ruling of this Court. -1- OPPOSITION TO EX PARTE APPLICATION OF DEFENDANT
