F47 DURING COVID-19 PANDEMIC To the parties herein and to their attorneys of record: YOU ARE HEREBY NOTIFIED/ORDERED: Dept. F47 does not conduct remote MSC’s/settlement conferences; live court appearances are required. However, due to the Covid-19 pandemic, Dept. F47 orders counsel/parties comply with the following procedures regarding MSC’s, until further notice: 1. If, due to the Covid-19 pandemic, any counsel does not wish to make a live court appearance: (a) Said counsel is to notify the court and all other counsel at least five (5) days before the MSC. (b) Counsel/Parties must meet and confer regarding settlement on or before the scheduled MSC. (c) Plaintiff’s counsel must notify the court on or before the scheduled MSC if the matter has settled. (d) If parties fail to notify the court as instructed above, and there are no appearances at the MSC, an order to show cause re sanctions for failure to appear will be scheduled, and trial/trial related dates will be vacated. NOTE: Remote appearances are allowed at scheduled MSC’s only to inform the court of the case status and/or requests to reschedule. 2. If all counsel agree MSC is to go forward with the judge’s participation: (a) Live court appearances are required by counsel; no remote appearances are permitted. (b) Parties and all other persons required to attend, have the option to make a live court appearance or be available to their respective counsel for contact during the MSC, without further order of the Court. However, all must be available and prepared to have a meaningful settlement conference. (c) If parties fail to notify the court that scheduled MSC will not go forward and fail to appear, an order to show cause re sanctions for failure to appear will be scheduled, and trial/trial related dates will be vacated.
