attorney of record, hereby files the instant Opposition to Defendant DOE 1’s Motion to Strike

Plaintiff’s Complaint for Damages (“Complaint”). Specifically, the present Motion to Strike should
25
be denied in its entirety, for the following reasons:

1. Plaintiff’s specific allegations addressed in Complaint ¶¶ 17-18, 32, 40, 50, 56, 66,

78, 169, 192, 200, 203, and 204 are relevant and proper;

5 (the Private Attorney Generals Act “PAGA”) is proper, as this litigation confers a
6 substantial public benefit; and
7 4. Plaintiff’s request for attorneys’ fees, pursuant to Civil Code §52, is proper.

1 MEMORANDUM OF POINTS AND AUTHORITIES
2 I. INTRODUCTION

Defendant DOE 1 attempts to strike various portions of Plaintiff JANE BWN DOE’s
4
(“Plaintiff”) Complaint for Damages (“Complaint”), including Plaintiff’s claims for Treble
5
Damages pursuant to Civil Code of Procedure (“C.C.P.”) §340.1, and attorneys’ fees under C.C.P.
6
§§ 1021.4, 1021.5 and Civil Code (“C.C.”) § 52. Moreover, Defendant DOE 1 attempts to strike
7
relevant and pertinent language as it relates to Defendant DOE 1 “conspiring” to “conceal” the abuse
8
its former employee and the perpetrator in this action, Defendant DOE 2.

Contrary to DOE 1’s misleading contentions, Plaintiff’s Complaint, and specifically the
10
allegations identified by DOE 1, are more than proper and relevant in this action. Moreover, as set
11
forth below, and also concurrently with Plaintiff’s Opposition to the Demurrer, the arguments by

DOE 1 fail, as there are more than adequate legal and factual grounds supporting Plaintiff’s claims

and allegations. As such, DOE 1’s Motion is meritless and should be denied outright.

II. FACTUAL BACKGROUND

A. THE PLAINTIFF

Plaintiff JANE BWN DOE was born in December 1981, and was a minor when she was
17
molested by the Perpetrator, DOE 2. Complaint (“C”) ¶6 to Declaration of Cristina J. Nolan
18
(“DCN”). The molestation took place while Plaintiff was a student at Berkeley High School
19
(“BHS”), a school located under the control and supervision of DOE 1. Id. As Plaintiff’s teacher,
20
DOE 2 came into contact with Plaintiff and many other young vulnerable females. C, ¶¶ 42-45.
21
The following is known: beginning in or around 1997, Plaintiff was sexually abused, harassed, and
22
molested by DOE 2 on school premises. C, ¶ 63. This abuse included but was not limited to: DOE
23
2 engaging in sexual talk and innuendo by DOE 2; and DOE 2 engaging in sexual fondling of
24
Plaintiff’s body by DOE 2. Id.

B. DOE 1’s ROLE IN DOE 2’s HISTORY OF SEXUAL ABUSE

Given the duties and relationship between DOE 1 and Plaintiff, DOE 1 stood in loco parentis
27
with the Plaintiff and thus, the Defendant owed Plaintiff a special duty of care. C, ¶¶ 47-48. This
28
was a “special relationship” and fiduciary relationship that Plaintiff had with the Defendants. C, ¶¶
